General terms and conditions of MANNTRA, Ottawa Zakinje 4, 52470 UMAG, Croatia.

1. General Provisions

1.1 These General Terms and Conditions (GTC) apply to all deliveries and services from the band MANNTRA in connection with orders placed by the customer via the online shop for merchandise items under the domain "Manntra-fanshop.com“.

1.2 Customers of the MANNTRA Merchandise site within the meaning of these General Terms and Conditions are consumers as well as entrepreneurs.

1.2.1. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be predominantly attributed to either their commercial or independent professional activity.

1.2.2. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Contractual partner, conclusion of the contract; contract language; Contract text storage

2.1 The contractual partner of the customer is the band Manntra.

2.2 The customer can choose from the range of Manntra merchandise items and collect them in a so-called shopping cart using the “add to cart” button. The customer can then log into his user account using an existing user account with a user name and password or create a new user account by entering his name, delivery address, email address and telephone number. The customer can then select the desired payment method and shipping method. The customer then receives an overall overview of the merchandise items they have selected, the shipping costs, the shipping and billing address and their contact details. The customer has the opportunity to check his order before sending it in order to identify and correct any input errors and by pressing the “Change shopping cart” buttons or the “Change quantity” buttons or by pressing the “Back” button on the Internet browser correct. The customer can cancel his order by deleting the shopping cart, pressing the logout button or closing the internet browser.

By submitting an order via the online shop by clicking the “order for a fee” button, the customer places a legally binding order. However, the application can only be submitted and transmitted if the customer has accepted these contractual conditions by clicking on the “Accept Terms and Conditions” radio button and thereby included them in their application. Only the customer's order constitutes an offer to Manntra to conclude a contract.

2.3 If the customer has placed an order with Manntra-fanshop.com, Manntra-fanshop.com will send the customer an email to the customer's specified email address with Manntra-fanshop.com confirms receipt of the customer's order and lists the details of the contract information with further information on the purchase process (order confirmation) and which the customer can print out using the "Print" function. In this way, manntra-fanshop.com informs the customer of the necessary contract information in text form. Such an email does not constitute a binding acceptance of the order, unless it also declares acceptance in addition to confirming receipt.

2.4 A contract is only concluded when Manntra-fanshop.com accepts the customer's order by sending another separate email (order confirmation) or by delivering the ordered items.

2.5 The contract text is saved by manntra-fanshop.com. If the customer has created a user account, the contract text for the purchase process remains stored therein after the contract has been concluded and can be accessed again by the customer using their data on the online shop's website under their user account. If the customer places an order via guest access, there is no possibility for the customer to view their order on the online shop's website.

2.6 The contract language is English.

3. Prices; payment terms; Consequences of default

3.1 The final prices shown on the manntra-fanshop.com website are in EURO including VAT. For cross-border deliveries, additional taxes and/or duties (e.g. customs duties) may be payable by the customer in individual cases.

3.2 When items are shipped, additional delivery and shipping costs apply, the amount of which will be specifically stated in the respective offer. The shipping costs depend on the shipping method chosen by the customer. Otherwise, the shipping costs are stated in our online shop under “Shipping costs”.

3.3 manntra-fanshop.com accepts the payment methods listed before the ordering process begins. The customer selects his preferred payment method from the available payment methods during the ordering process.

3.4 In the event of an agreed advance transfer/bank transfer/PayPal, the purchaser undertakes to pay the final price plus any applicable delivery and shipping costs without deductions no later than fourteen days after receipt of the payment request sent separately by email; The crediting of the amount is decisive for meeting the deadline. The account details will be communicated together with the payment request.

4. Delivery conditions; Assumption of risk

4.1 The delivery of the item(s) takes place - unless otherwise stated in individual cases on the manntra-fanshop.com website and agreed with the customer - by shipping. In the event of an agreed advance payment, the item(s) will only be handed over to the customer after payment of the full purchase price plus delivery and shipping costs.

4.2 The delivery time depends on the offers stated for the items on the manntra-fanshop.com website.

4.3 manntra-fanshop.com points out that the risk of accidental loss of the items for entrepreneurs is transferred when the items are handed over to themselves or to a person authorized to receive them, whereas in the case of mail order purchases, the risk of the items being delivered to a suitable transport person is transferred.

4.3.1 In contracts with consumers, the risk of accidental loss of the items sold always only passes to the consumer when the items are handed over to the consumer; This also applies to mail order purchases.

4.3.2 The risk of accidental loss of the items sold is transferred to the customer even if the customer defaults on acceptance.

5. Final provisions

The following applies to contractual relationships between the customer and manntra-fanshop.com:

5.1 The law of the Federal Republic of Germany applies.

5.2 For consumers, this choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.

5.3 The provisions of the United Nations Convention on Contracts for the International Sale of Goods (UN Convention on Contracts for the International Sale of Goods) do not apply.

5.4 If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and manntra-fanshop.com is the headquarters of the Manntra Band. This does not affect the Manntra Band's right to appeal to the court at another legal place of jurisdiction.

5.5 If the customer does not have a place of residence in the Federal Republic of Germany or moves his place of residence abroad after conclusion of the contract or his place of residence is not known at the time the action is filed, the place of jurisdiction for all disputes arising from and in connection with the contractual relationship is exclusively the registered office of Band Manntra.

5.6 The remaining parts of the contract remain binding even if individual points are legally ineffective. In place of the ineffective points, the statutory provisions apply, if available. However, if this would represent an unreasonable hardship for one of the contracting parties, the contract as a whole will be invalid.
